A judge has denied Miley Cyrus‘ request to dismiss a plagiarism suit filed against her, Billboard reports.

The singer is accused of using elements of Bruno Mars’ hit When I Was Your Man in her hit Flowers.

Cyrus filed the request in court in late November. According to Cyrus’ legal team, the suit filed by Tempo Music Investments, which owns part of the copyrights to When I Was Your Man, did not contain enough information to form an opinion on the allegations.

However, the judge in Los Angeles did not agree.

The ruling does not mean that the judge will rule in favor of the plaintiffs. The judge has yet to make that decision.

According to Tempo Music Investments, Cyrus and her co-writers have “taken over the pitch, bass line, verse order and certain lyrical and theatrical elements” from When I Was Your Man.

Tempo Music Investments is therefore demanding damages and wants the singer to stop performing the song.

Flowers was one of the biggest hits of the year in 2023. In the Netherlands, the song was number one for ten weeks.

Cyrus also won a Grammy for the song.
